Privacy Notice

This Privacy Notice was updated on January 11, 2017 to include the following: (i) update information about EP’s compliance with the EU – U.S. Privacy Shield framework; (ii) additional information regarding how we collect and use information submitted to us by our users and our clients; and (iii) edits to improve readability and clarity.

 

Entertainment Partners and its affiliates (“EP”, “we”, “us” and “our”) are committed to maintaining meaningful privacy protections for our clients and users under the Principles (as defined below). This Privacy Notice describes EP’s practices with respect to your personal information.

This Privacy Notice also discusses our implementation of the Principles, the types of information we gather, how we use it and the notice and choice affected individuals have regarding our use of that information that we collect through:

  • your browsing activity on our websites www.ep.com, www.centralcasting.com, www.scenechronize.com, www.epfinancialsolutions.com, and all other related websites where this Privacy Notice is referenced, but specifically excluding hosted applications, services and tools (our “Websites”);
  • our provision and your use of our hosted applications, services and tools (collectively, “Online Services”); and
  • our provision of payroll and payroll-related services (collectively, “Payroll Services”) to our clients, including personal information of any entertainment production workers (“Production Workers”) that we receive in connection with the Payroll Services.

 

Notice

We provide access to our Privacy Notice by:

  • linking it throughout our Websites;
  • referencing it in our Terms of Use and End User License Agreements; and
  • incorporating it into our contracts, agreements and other documents as necessary or appropriate.

 

EU-U.S. Privacy Shield

EP participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework.  EP is committed to subjecting all personal data received from European Union (EU) member countries, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles.  To learn more about the Privacy Shield Framework, visit the U.S. Department of Commerce’s Privacy Shield List.

EP is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf.  EP complies with the Privacy Shield Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, EP is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission.  In certain situations, EP may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Under certain conditions, more fully described on the Privacy Shield website https://www.privacyshield.gov , you may invoke binding arbitration when other dispute resolution procedures have been exhausted.

 

Personal Information Defined

As used within this Privacy Notice, “personal information” means any information recorded in any form that relates to an individual and identifies or can be used to identify an individual, including, but not limited to, a first and last name, email address, a home, postal or other physical address or other unique identifier.

 

Browsing EP Websites

When you browse our Websites, you do so anonymously, unless you have previously indicated that you wish EP to remember your login and password. We don’t automatically collect personal information, including your email address. We do log your IP address (the Internet address of your computer) to give us an idea of which part of our Websites you visit and how long you spend there. But we do not link your IP address to any personal information unless you have logged in to our website. Like many other commercial websites, our Websites may use a standard technology called a “cookie” to collect information about how you use the site. While browsing our Websites, EP does collect personal information when you register with EP for an EP account, when you register to attend a seminar or participate in an online survey, when you ask to be included in an email or other mailing list, when you submit an entry for a sweepstakes or other promotions or when you submit your personal information to EP for any other reason. From time to time, EP receives personal information from business partners and vendors. EP only uses such information if it has been collected in accordance with acceptable privacy practices consistent with this Privacy Notice and applicable laws, including but not limited to the Principles.

 

Our Provision and Your Use of the Online Services

Access to our Online Services will require a login and a password. The use of our Online Services, and the information or applications accessible from those sites, may be governed by a written agreement between you and/or your employer and EP. Unless you request deletion of your personal information as specified below, your personal information may be retained by EP to verify compliance with any applicable agreement, log software licenses granted, track software downloaded from those pages or track usage of other applications available on those pages.

When you submit your personal information in connection with the provision or use of the Online Services, this Privacy Notice describes how we collect and use your personal information. Your use of the Online Services shall constitute your consent to the terms of this Privacy Notice and any changes to this Privacy Notice that may be made to it in the future in accordance with the terms set forth in this Privacy Notice.

Below are additional privacy considerations specific to our provision and your use of the Online Services:

Personal Information Collection Practices – EP hosts information and data under the direction of its clients through the Online Services, including personal information regarding individuals affiliated with EP’s clients. Notwithstanding the foregoing, EP may also have a direct relationship with such individuals whose personal information it processes, i.e., through the Payroll Services.

Choice – Since EP hosts information and data on its Online Services under the direction of its clients, please contact the EP client that you interact with directly if you have any questions or concerns regarding any personal information that may be hosted on the Online Services. If you are an EP client and would like to update your account, please contact your EP Account Representative.

Access to Data Controlled by EP’s Clients – EP acknowledges that you have the right to access your personal information. Since EP hosts information and data on its Online Services under the direction of its clients, an individual who seeks to correct, amend or delete inaccurate data should direct the inquiry to the specific EP client at issue. If the EP client cannot directly remove the data and specifically requests EP to remove the data, we will respond to their request within the timeframes prescribed in the applicable agreement between EP and the client.

Data Retention – EP will retain personal information we process on behalf of its clients for as long as needed to provide services to its clients. EP will retain and use this personal information as necessary to comply with its legal obligations, resolve disputes and enforce its agreements.

 

In Connection with Payroll Services

EP is committed to protecting the privacy and security of all personal information that we process in order to provide Payroll Services to our clients. We receive personal information from our clients about their current, prospective and former Production Workers as well as information regarding their dependents and family members. This notice explains our practices with regard to all of the personal information we, as a provider of Payroll Services, receive from our clients.

EP collects and processes personal information of Production Workers only as instructed or permitted by our client or the specific Production Worker, or as otherwise required for EP to fulfill its legal obligations.

EP will disclose all of your personal information to the EP client receiving Payroll Services. We may disclose your personal information to our affiliates and data processors as needed to provide the Payroll Services, each of whom will be contractually bound to limit use of your personal information as needed to perform the Payroll Services.

Failure to provide accurate or complete information or failing to consent to this Privacy Notice may impact our ability to provide Payroll Services.

 

Notice Prior to Collection

When personal information is collected, we will inform you at the point of collection the purpose for the collection. EP will not transfer your personal information to third parties without your consent, except under the limited conditions described under the discussion entitled “Information Sharing and Disclosure” below. If you choose to provide us with your personal information, we may only transfer that information within EP, with our affiliates or our third party service providers in accordance with this Privacy Notice. Upon receiving your permission, we may transfer your information across borders and from your country or jurisdiction to other countries or jurisdictions around the world.

We will always give you the opportunity to “opt out” of receiving direct marketing or market research information. This means we assume you have given us your consent to collect and use your information for the purposes for which it was collected and in accordance with this Privacy Notice unless you take affirmative action to indicate that you do not consent, for instance, by clicking or checking the appropriate option or box at the point of collection. In some cases, when applicable, we will provide you with the opportunity to “opt in.” This means we will require your affirmative action to indicate your consent before we use your information for purposes other than the purpose for which it was submitted.

 

Tracking Technologies

As is true of most websites, we gather certain information automatically and store it in log files. This information may include your IP addresses, browser type, internet service provider, referring/exit pages, operating system, date/time stamp, and/or clickstream data. We may combine this automatically collected log information with other information we collect about you. We do this to improve the services we offer to you, and to improve marketing, analytics or site functionality.

EP, its affiliates and/or service providers (e.g., email distribution vendors, third party payment portals, hosting and managed services vendors), use technologies such as cookies, beacons, tags and scripts to analyze trends, administer the Websites, track users’ movements around the Websites and gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis.

Some parts of EP’s Websites use cookies to track user traffic patterns. We do this in order to determine the usefulness of our Websites’ information to our users and to see how effective our navigational structure is in helping users reach that information. If you prefer not to receive cookies while browsing our Websites, you can set your browser to warn you before accepting cookies and refuse the cookie when your browser alerts you to its presence. You can also refuse all cookies by turning them off in your browser, although you may not be able to take full advantage of our Websites if you do so. In particular, you may be required to accept cookies in order to complete certain actions on our Websites. You do not need to have cookies turned on, however, to use/navigate through many parts of our Websites, except access to certain of EP’s Websites may require a login and password.

We partner with a third party to either display advertising on our Websites or to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on our Websites and other sites in order to provide you advertising based upon your browsing activities and interests. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here. Please note this does not opt you out of being served ads. You will continue to receive generic ads. We and third parties with whom we partner with use Local Storage, such as HTML5, to store content information and preferences. Various browsers may offer their own management tools for removing HTML5.

EP’s Websites include Social Media Features, such as the Facebook Like button and Widgets, such as the Share This button or interactive mini-programs that run on our Websites. These features may collect your IP address, which page you are visiting on our Websites, and may set a cookie to enable the feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Websites. Your interactions with these features are governed by the privacy notice and/or policy of the company providing it.

 

Information Sharing and Disclosure

Because EP is a global company, your personal information may be shared with our affiliates around the world. All such entities are governed by this Privacy Notice or are bound by the appropriate confidentiality and data transfer agreements.

Your personal information is never shared outside EP without your permission, except under the conditions explained below. Inside EP, data is stored in controlled servers with limited access. Unless otherwise agreed to in writing with EP, your information may be stored and processed in the United States or any other country where EP, its subsidiaries, affiliates, service providers or agents are located.

EP may send your personal information to other companies or people under any of the following circumstances:

  • you have provided your consent to share the information;
  • we need to share your information to provide the product or service you have requested; or
  • we need to send the information to companies who work on behalf of EP to provide a product or service to you (we will only provide those companies the information (i) they need to deliver the service, or (ii) for the purposes for which the information was initially collected, and they are prohibited from using that information for any other purpose).

We will also disclose your personal information if required to do so by law, to enforce our Terms of Use, or in urgent circumstances, to protect personal safety, the public or our Websites. EP may also share your personal information when we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (1) satisfy any applicable law (foreign, federal, state or local), regulation, legal process or enforceable government request, (2) detect, prevent or otherwise address fraud, security or technical issues, (3) protect against harm to the rights, property or safety of EP, its users or the public as required or permitted by law or (4) if EP is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

Finally, EP may also share with third parties certain aggregate information (or anonymized, de-identified or pseudonymized data) regarding the use of EP’s services or Websites, such as, for example, the number of people who visit certain web pages or use certain services offered by EP.

 

Data Security

Your EP account information is password-protected for your privacy and security. EP safeguards the security of the data you send us and takes reasonable and appropriate measures to protect it from loss, misuse, and unauthorized access, disclosure, alteration, and destruction with physical, electronic, and managerial procedures. In certain areas of our Websites, EP uses industry-standard SSL-encryption to enhance the security of data transmissions. While we strive to protect your personal information, we cannot ensure the security of the information you transmit to us, and so we urge you to take every precaution to protect your personal information when you are on the Internet. Change your passwords often, use a combination of letters, numbers and special characters, and make sure you use a secure browser.

EP restricts access to personal information to EP employees, contractors and agents who need to know and have access to this information. Although EP takes reasonable steps to protect the data that it collects from its users, it is simply not possible to protect against every conceivable breach of security. Although we do our best to make our Websites and data secure, we cannot guarantee the total security of our Websites and data. Accordingly, you agree that you will not hold EP responsible, and hereby release EP, for any inadvertent or unauthorized disclosure of user information that may occur, such as, for example, by a person hacking into our system and unlawfully gaining access to our data.

EP processes personal information for the purpose for which it was collected and in accordance with this Privacy Notice. EP reviews its data collection, storage and processing practices to ensure that it collects, stores and processes personal information needed to provide or improve its services, or as otherwise permitted under this Privacy Notice.

 

Data Retention

We will retain your information for as long as your account is active or as needed to provide you and/or the EP client services. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us at privacy@ep.com. Notwithstanding your request, we reserve the right to retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

 

Correcting and Updating Your Information

Upon request EP will provide you with information about whether we hold any of your personal information.

EP depends upon its users to record, update and correct their personal information whenever necessary. EP asks that individual users review and update their personal information from time to time as this information becomes outdated. For this purpose, EP will allow you access to your personal information in order to correct, amend or delete inaccurate information. However, EP may decline to process requests to update information that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others or that would be impractical. We will respond to your request to access within a reasonable amount of time, but no later than 30 days after the date of receipt of your request.

 

Children and Privacy

Our Websites do not target and are not intended to attract children under the age of 13. EP does not knowingly solicit personal information from children under the age of 13 or send them requests for personal information.

 

California Residents

If you are a California resident, you may ask us to refrain from sharing your information (whether collected online or offline) with our affiliates for their marketing purposes, if the affiliates are separate legal entities. Please tell us your preference by contacting us as indicated in the “Changes to This Privacy Notice” section below.

 

Third Party Applications and Sites

EP may make available third party applications through its Online Services and Websites. The information collected by EP when you enable a third party application is processed under this Privacy Notice. Information collected by third party applications is governed by the privacy notice and/or policy of the third party application provider, so you should review and consider said privacy policies when using third party applications.

EP’s Websites contains links to other sites. EP does not share your personal information with those websites and is not responsible for their privacy practices. We encourage you to learn about the privacy policies of those companies.

Our Websites may contain links to websites operated by other companies. Some of these third party sites may be co-branded with an EP logo, even though they are not operated or maintained by EP. Although we choose our business partners carefully, EP is not responsible for the privacy practices of websites operated by third parties that are linked to our Websites or the content of those sites. In any event, once you leave our Websites, you should check the applicable privacy notice and/or policy of the third party website to determine how they will handle any information they collect from you. EP does not endorse or control any of the websites for which links are provided on EP’s Websites, and users assume all risks of using these other websites and assume all responsibility for the policies and procedures of these other websites.

 

Accountability for Onward Transfers

Prior to disclosing your personal information to a third party, EP will notify you of such disclosure and allow the you the choice to opt-out of such disclosure unless the disclosure meets an employment requirement or other legal obligation under applicable law. EP will enter into contracts to ensure that any third party to whom personal information may be disclosed is aware of and adheres to the Principles or is subject to law providing the same level of privacy protection as is required by the Principles and agrees to provide an adequate level of privacy protection. EP will also, upon notice, take reasonable and appropriate steps to stop and remediate unauthorized processing by third party agents and agrees to provide a summary or a representative copy of the relevant privacy provisions of its contracts with agents to the U.S. Department of Commerce upon request.

 

Changes to This Privacy Notice

EP may amend this Privacy Notice from time to time consistent with the requirements of the EU – U.S. Privacy Shield framework. We will post any revised Privacy Notice on this Website. If we make any change in how we use your personal information we will notify you by email (sent to the email address specified in your account) or by means of a notice on this Website prior to the change becoming effective. We encourage you to raise any concerns regarding this Privacy Notice and our privacy practice using the contact information provided below and we will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of personal information in accordance with applicable laws.
