I am an independent contractor. Can you issue my wages on a 1099 instead of a W-2?

No. The federal government considers any person under an employer’s direction or control (i.e., the employer dictates hours and/or conditions) an employee. As such, withholding and employer taxes (e.g., FICA, SUI, and FUI) are due on wages and taxable allowances.

If the employer fails to comply, potential liabilities exist for all unpaid federal, state, and municipal taxes. In addition, penalties and interest may be levied. Even if the income is reported on a 1099 form, there would be no relief from these obligations if the individual is deemed an employee. Therefore, EP does not pay independent contractors.

If you have any questions, please contact EP’s W-2 Group:

  • Email: w2group@ep.com

I put different exemptions on my vouchers. Why don’t my paychecks match the exemptions on my voucher?

In Casting Payroll, we often process vouchers for more than one work date at the same time. The system calculates all paychecks processed on any given day with the number of exemptions on the last voucher that was input into the system. If you vary the number of exemptions you are claiming daily, we cannot guarantee that any particular voucher will match your paychecks. The box for the number of dependents should reflect the number of exemptions you are able to claim.

I received my pay stub and my W-4 allowances have been changed, even though I did not request a change. Why was this made?

From time to time, the IRS (under the IRC section 3402) sends a “Lock in Letter” notifying the employer that a given employee is not entitled to claim a complete exemption from withholding or more than a specified number of withholding allowances. This “lock” cannot be removed until we receive a modification or release from the IRS.

Does this answer your question? (0) (0)

I updated my W-4 information when completing the Start Card paperwork; however, it was not honored. What can I do to have this updated?

EP will honor all W-4 requests submitted unless we have received a notice from the IRS or a State agency disallowing the W-4 update. In this instance, as an employer, EP is required to honor the government issued notice. Upon request, EP will supply you with a copy of this notice; you will be required to contact the issuing agency to resolve the matter. Once the matter has been resolved, the issuing agency will send EP an updated document indicating the allowed changes.

Why am I having a problem cashing an EP check at Bank of America?

Background: Each hour of each business day, EP transmits files to the Bank of America (BofA) containing the lists of all checks that EP has issued. BofA then posts those files to its system so that when an employee comes into a branch to cash a check, the bank teller can access the check in his/her computer to verify that EP did, in fact, issue that check. It is BofA’s policy always to verify issuance of a check before cashing it over the counter at a teller’s window. Sometimes, an employee arrives at a BofA branch before it has received the files or before it has posted them to its teller system. In either case, the teller receives a computer prompt instructing the teller to call an internal number at BofA to verify the check. The bank personnel answering that internal number in turn call EP to verify that the check is valid. If for any reason the teller does not follow this procedure, the employee should ask to see the branch manager. If the issue is still unresolved after speaking to the branch manager, the employee should call the EP Treasury department at 818.955.6000. EP’s Treasury personnel will then contact BofA’s corporate offices and ask that the branch be called directly to assist in getting the check cashed for the employee. If it is necessary to contact EP’s Treasury department to assist in having a check cashed at a BofA branch, the employee should ask the BofA branch personnel for the following information to expedite the process: both the branch ID number and the branch’s direct phone number.

Why do I sometimes receive my paychecks out of work-date order?

Checks are not mailed in date order. Vouchers are processed as they come in from the production company, and individual production companies vary on how often they send the vouchers.
