Notice of Exchange
The Notice of Exchange (NOE) rule covers all employers subject to the FLSA, not only those employers subject to the ACA Employer Mandate. Employers must distribute a notice to all current employees (including union, non-union, full-time and equivalent, and part-time) about government health insurance exchanges. The NOE notifies employees of whether or not you will offer compliant health coverage to full-time employees. The U.S. Department of Labor (DOL) has published two model NOEs for employers—a version for those employers who offer health insurance and one for those employers who do not.
